USER AGREEMENT

The third party that accepted the offer, located at https://www.gurmanapp.com/en/terms-of-use, on the one hand, and the limited liability company "GURMAN APP" represented by director Hayk Abrahamyan, based on: the company's charter, on the contrary, collectively referred to as the "Parties" and the "Party", have entered into this User Agreement (hereinafter referred to as the Agreement) on the following.

Terms and Definitions

1.1. Unless otherwise expressly provided in the text of the Agreement, the following terms and definitions in this Agreement have the following meanings:

Reservation: a correctly formulated request by the User through the platform to reserve a table in a restaurant.

Provider: the owner or managing body of the restaurant that manages the reservation and restaurant data through the platform.

User: any person who accesses the platform, makes a reservation or uses other Gurmanapp services.

Platform: The Gurmanapp system includes mobile applications, web interfaces, and administration tools. The Platform is an Internet resource designed to publish various Events the Contractor holds and receive information about them.

No-show is when the User does not show up at the appointed time without prior cancellation.

Ticket (Booking Confirmation): An electronic record certifying the User's rights to use the Provider's services at the specified time.

Event: an event organised by the Contractor (festival, concert, entertainment program, training, etc.) for an indefinite number of Users.

Bank account: the Company's current bank account in the bank specified in paragraph 9 of this Agreement.

1.2. Other terms shall be interpreted following the legislation of the Republic of Armenia.

1.3. The titles of chapters, sections, and articles are intended solely for the convenience of using the text and have no legal significance.

Subject of the Agreement

2.1. The Company allows the User to use the Platform in the manner and on the terms specified in this Agreement, and the User undertakes to use the Platform on the terms specified in this Agreement, if necessary.

2.2. Based on the Agreement, the User has the opportunity to use the Platform, including receiving information about the Events posted on the Platform, as well as receiving the opportunity to participate in the Events by booking a table, performing the events planned by the Contractor (in particular, by registering and, if necessary, making the appropriate payment) and receiving a Ticket from the Company. In addition, the User has the right to use the Platform in any other way the Company determines—such as selling tickets to Users.

2.3. The Company is not the Event organiser or the service provider, but, subject to the existence of relevant service agreements, it may undertake any part of the Event's organisation.

Between the User and the Contractor and/or third parties.

2.4. By this Agreement, the User gives his consent to the Company to transfer his rights, duties, and obligations under this Agreement to other persons at any time.

Rights and obligations of the parties

3.1. The User is obliged to:

3.1.1. Properly fulfil his obligations under this Agreement and the terms of the Agreement.

3.1.2. familiarise yourself with the current version of this Agreement each time you visit the Platform before using the Platform.

3.1.3. strictly observe and comply with the rules for using the Platform.

3.1.4. provide only reliable, correct and complete information on the Site and in no case mislead the Company and/or other Users and/or third parties.

3.1.5. independently check the Order details before placing it. The User is responsible for the accuracy and legality of the data provided by him/her when placing the Order.

3.1.6. familiarise yourself with the information about the Event (content, procedure, place, time, conditions, etc.) before placing the Order, then the User undertakes to refuse to place the Order and participate in the Event.

3.1.7. familiarise yourself with the terms and rules regarding payment methods.

3.1.8. refuse to participate in the Event after placing and paying for the Order, only under the conditions posted on the Website. The rules for refunding money paid for tickets are posted on the Platform.

3.1.9. pay for the Ticket (Order) in full independently or through other persons.

3.2. The Company has the right to:

3.2.1. terminate, suspend and/or block the User's access to the Platform if, in the Company's opinion, the User's activity poses a threat to the Site and/or other Users and/or third parties, and if the User violates the terms of the Agreement or other requirements of the Company.

3.2.2. refuse to process the User's Order without explanation.

3.2.3. unilaterally change the technologies and operating conditions of the Platform.

3.2.4. change and/or delete any information entered or posted by the User of the Platform at its discretion and without obtaining additional consent from the User.

3.2.5. stop the Platform, carry out preventive maintenance, and make changes.

3.2.6. Use the data of the User or other persons whom the User has entered the Platform for marketing purposes. The User certifies and guarantees that the data entered by him/her on the Platform is provided by him/her and third parties voluntarily and that third parties. The Parties have read the terms of the Agreement.

3.2.7. Send informational and advertising messages to the User and other persons, information about whom is entered by the User, both to the e-mail address specified on the Site and by sending a message to the phone number specified on the Site. The User hereby provides his/her. Consent to receive such messages also guarantees that the persons about whom he/she entered information on the Platform have also consented to receive messages.

3.2.8. verify the data of the User's data and other persons specified by the User in accordance with the standards of the Company and/or the Provider. In addition, the Company has the right to request the User to provide identification and other necessary documents and data. The right to stop/block the User's access to the Platform and prohibit the User from using Identity Documents and the types of data and forms of presentation are determined by the Company independently.

3.2.9. Contact the User via the means of communication they specified.

Booking process

4.1. Booking

The User must log in to the platform, select a restaurant, and specify the day, time and number of guests.

The User can select an Event, a Ticket, and provide the required data on the Payment page (the data must be reliable, truthful and in the required volume).

Confirm the veracity and accuracy of the entered data and complete the Booking by clicking the "Pay" button.

4.2. The Company confirms receipt of the Booking by sending a confirmation message to the email address specified during registration and transfers the Booking data to the contractor.

4.3. If the Booking time coincides with the Event, the User must pay for the Booking. After confirmation, the User will be redirected to the Booking payment page. After payment, the Company sends the User a message about receiving the payment and creates a Ticket, which is sent to the user's email address.

4.4. The moment of payment for the order is the crediting of the paid funds to the bank account. In case of payment by third parties in favor of the User, rights and obligations arising from the payment arise between the Company and the User. and in no case are the basis for their emergence between the Company and other persons.

4.5. The User participates in the Event(s) on the terms established by the Contractor(s).

4.6. Cancellation

The User may cancel the reservation within the timeframe established by the restaurant without penalty.

Delay in cancellation may result in a reduction in the User's status or other restrictions.

The User will be refunded the full cost of the ticket(s) to the Event if the cancellation is made by the User no later than five days before the Event.

The User will be refunded the full cost of the ticket(s) to the Event if the Contractor or the Company makes the cancellation.

4.7. Represented

The Supplier may mark the reservation as "No Show" if the User does not show up at the appointed time.

The User will be notified of this status by email.

Responsibility of the Parties

5.1. The information posted on the Site (including Events and services) is entered by the Contractor and/or third parties, and the Company shall not be liable for the accuracy, veracity, or completeness of the posted information or damage caused to Users. Or other persons using such information are not obliged to edit, check, or control the information entered by the Contractor and/or third parties. The Company does not guarantee access by the Contractor and/or third parties. The completeness, accuracy, and veracity of the information, as well as the Users themselves, bear all risks arising from using the information. The User understands and accepts that the Platform may contain inappropriate, offensive, or contradictory information.

5.2. The Company shall not be liable for any inappropriate behaviour of persons using the Platform. The Company shall also not be liable for any failure to fulfil or partial fulfilment of the information posted on the Platform, as well as for any damage caused to the User. or any other person during the Events for moral, financial, physical, etc.), except the proper fulfilment of the obligations imposed on it by the relevant agreements, only by the Contractor (according to the appropriate contracts). 5.3. The Company does not guarantee that:

5.3.1 The Platform will meet the expectations and requirements of the User,

5.3.4 The Platform will operate continuously, without interruptions, quickly, without errors,

5.3.5 All errors on the Platform will be corrected.

5.4. Part or all of the platform may occasionally be unavailable due to technical and preventive maintenance.

5.5. The User uses the Platform at their own risk, makes orders, and makes payments, and the Company is not liable for any damage caused to the User.

Personal data

6.1. If the User enters their data (including personal data) on the Platform or otherwise transfers them to the Company and/or the Contractor, the User thereby gives their consent for the Company and/or the Contractor to collect, process, store, transfer, delete, block their data, both with and without the use of automated means. When registering for an event on the website, the User understands and agrees that their data will be transferred and made available. To the Contractors.

6.2. About personal data, the Company's policy complies with the requirements stipulated by the legislation of the Republic of Armenia.

Dispute resolution

7.1. The Agreement and all relations arising from it are regulated in accordance with the legislation of the Republic of Armenia. Disputes between the Parties shall be resolved in accordance with the legislation of the Republic of Armenia.

7.2. The Parties shall endeavor to resolve all disputes, disagreements or claims related to the execution of the Agreement, termination of the Agreement or recognition of the Agreement as invalid. to the postal address indicating the claims and/or disagreements that have arisen.

7.3. Within 15 (fifteen) business days after receiving the message specified in paragraph 7.2 of this Agreement, the receiving Party shall send a response to the message.

7.4. If the Party sending the message 17

(Seventeen) business days, if the other Party does not receive a response or the dispute is not resolved, it shall be resolved in court in accordance with the legislation of the Republic of Armenia.

Entry into force of the agreement, change of terms

8.1. This Agreement, the text of which is permanently located on the Internet at https://www.gurmanapp.com/hy/terms-of-use, contains all the essential terms of the Agreement and is an offer of GURMAN APP LLC. Conclude an Agreement with the User on the terms specified in the text of this Agreement. Thus, in accordance with Article 453 of the Civil Code of the Republic of Armenia, the text of this Agreement for the provision of services through the use of the Internet is. a deliberate public offer.

8.2. According to Part 3 of Article 454 of the Civil Code of the Republic of Armenia, the following action of any third party is considered proper acceptance of this offer:

8.2.1 Entering information into the purchase form and confirming the accuracy of the data by clicking the "Pay" button,

8.3. The Agreement is considered concluded from the moment the "Pay" button is clicked or the Booking is made free of charge.

8.4. The Company has the right to unilaterally refuse to perform this Agreement at any time (unilaterally terminate this Agreement out of court) by posting a corresponding notice on the Platform and/or notifying the User thereof.
